As can be seen from what we say above, we think that the best way to learn about legal history is by reading documents. There is a quite good textbook of European legal history that has just been published in English, Antonio Padoa-Schioppa, A History of Law in Europe (first Italian ed. 2007, first English ed. 2017). It is long and expensive.
It would not be much of a recommendation for Chambers' theory if it could be said to justify “atrocious” (see J. Penner, The Law of Trusts 8 th ed. (Oxford 2012) p. 119) outcomes such as that in Re Vinogradoff. In any event, it is no more probable that the aunt “did not intend to benefit” the child than that the aunt intended to make the child a trustee.
I have treated in a former work some of the questions of social history connected with the period of the formation of Common Law. In the present volume I should like to follow up these investigations into an earlier and more obscure period--into the eleventh century, which witnessed the definite settlement of the Danes, the overthrow of the Anglo-Saxon system, and the beginnings of Norman rule.
